The police will be on the lookout for phones on wheels starting July 1.

Starting next week, officers can pull you over for texting and driving in Florida – but there is a loophole. It may not be that easy for them to give you a ticket for doing this.

If you’re pulled over for texting and driving, you have to give the officer permission to look at your phone before they do so. However, legally, you are not required to hand over your phone for them to inspect it.

Law enforcement will have to prove that an individual was actually texting rather than just checking their GPS or switching a song on iTunes. That is where the challenge comes in for police officers; the burden of proof lies on them.

St. Petersburg Police say this will be hard to prove because before asking for your permission, they must inform you of your right to say no.

A news crew interviewed one citizen who immediately said, “No, I wouldn’t hand my phone over.”

A law enforcement official said, “You never know what people might do. I just know that in most cases, people are going to wise up to this and they’re going to say, ‘no, I don’t want to give you my phone.'”

With so many loopholes, St. Petersburg Police say they are giving their officers extra training so they fully understand the law.
